The McKinney-Vento Act states that homeless children and youth must have access to the same educational services provided to other students. Children and youth who lack a fixed, regular, and adequate nighttime residence are considered to be homeless. In determining whether or not a child or youth is homeless, the LEA should consider the living arrangements. Determinations of homelessness should be made on a case-by-case basis. Always remember what is in the best interest of the child when making decisions. - NCHE, 2007
